This Privacy Notice describes how GenseeAI Inc. ("GenseeAI," "we," "us," or "our") collects, uses, discloses, retains, and protects information when you access or use our website, platform, products, services, AI agents, workflows, developer tools, integrations, APIs, documentation, support, and related offerings, including Gensee Crate, Gensee Search, and Gensee Deep Research, collectively, the "Services."

Some data practices differ depending on your account type. If you use the Services through a free, trial, beta, evaluation, preview, or other non-paid account, we may use certain information, including Service Content and AI Sessions and Interaction Data, for Model and Service Improvement, subject to the choices described in this Privacy Notice.

For paid, enterprise, and customer-contract accounts, GenseeAI does not use AI session content or uploaded files for Model and Service Improvement unless you or your organization explicitly enables that use or separately agrees in writing. For all account types, GenseeAI does not routinely inspect uploaded file content and only accesses file content as needed to provide the Services, respond to user-requested support, maintain security, prevent abuse, comply with law, or enforce our terms.

For purposes of this Privacy Notice, "Model and Service Improvement" means activities to evaluate, test, train, fine-tune, develop, and improve our Services, including AI agents, workflows, platform functionality, evaluation systems, safety systems, and models.

Effective Date and Existing Users

This Privacy Notice is effective for users who register for a GenseeAI account on or after May 14, 2026.

If you registered for a GenseeAI account before May 14, 2026, this Privacy Notice does not apply to your existing account unless and until we provide notice and you accept this Privacy Notice, opt in to the applicable data uses or settings, or otherwise agree.

Until then, your existing account remains governed by the GenseeAI Privacy Notice that previously applied to your account.

1. Information We Collect

We collect the following categories of information, depending on how you use the Services and your account type.

Account and Contact Information

This includes information such as your name, username, email address, organization, role, account identifiers, services or products you register for, plan type, account settings, and similar information you provide when creating or managing an account.

Device, Network, and Log Information

This includes technical information such as IP address, browser type and version, user agent, device identifiers, operating system, referral URLs, pages visited, timestamps, cookie identifiers, approximate location derived from IP address, and other logs generated when you access or use the Services.

Usage and Operational Data

This includes information about your activity within the Services, such as actions taken, features used, workflows or agents created or run, configuration choices, system events, error codes, latency, execution duration, performance metrics, request metadata, diagnostic logs, and related inputs or context needed to operate, troubleshoot, secure, analyze, and improve the Services.

AI Sessions and Interaction Data

This includes prompts, messages, instructions, uploaded or referenced files, input data, context provided to AI models, model inputs and outputs, generated content, tool calls, execution traces, feedback, ratings, corrections, and session-level metadata.

Uploaded File Content

When you upload, reference, or connect files to the Services, GenseeAI processes those files as needed to provide the functionality you request, such as reading, indexing, analyzing, summarizing, transforming, searching, or otherwise using the files in connection with your workflows, agents, prompts, or other service actions.

GenseeAI does not routinely inspect or manually review uploaded file content. Authorized GenseeAI personnel and service providers may access or review uploaded file content only where reasonably necessary to provide support requested by you, troubleshoot issues, maintain security, investigate abuse or policy violations, comply with law, enforce our terms, or as otherwise permitted by this Privacy Notice and applicable agreements.

Support, Feedback, and Communications

This includes information you provide when you contact us, request support, submit feedback, report bugs, complete surveys, or otherwise communicate with us.

Cookies and Similar Technologies

We use cookies and similar technologies to collect information about your activity, preferences, and device. You can control cookies through your browser settings and other tools.

Analytics and Session Replay

We use Microsoft Clarity and similar tools on our company homepage and Gensee Deep Research app to understand how users interact with those services through behavioral metrics, heatmaps, session replay, cookies, and related technologies. We use this information for analytics, debugging, security, product improvement, and marketing measurement. We do not use Microsoft Clarity on the GenseeAI web app. For more information about Microsoft's data practices, please review the Microsoft Privacy Statement.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide, operate, and maintain the Services. This includes enabling you to access and use the Services, authenticating users, managing accounts, processing requests, running workflows and AI agents, generating outputs, and providing requested functionality.
  • To secure the Services. This includes detecting, preventing, investigating, and responding to fraud, abuse, security incidents, misuse, malicious activity, unauthorized access, and violations of our terms or policies.
  • To troubleshoot and support the Services. This includes debugging errors, resolving technical issues, responding to support requests, monitoring performance, and improving reliability.
  • To analyze and improve the Services. This includes understanding usage patterns, measuring performance, improving user experience, developing new features, conducting internal analytics, testing functionality, and improving reliability.
  • For Model and Service Improvement. For free, trial, beta, evaluation, preview, and other non-paid accounts, this may include using eligible information to evaluate, test, fine-tune, train, and improve our AI agents, workflows, platform functionality, evaluation systems, safety systems, and models, unless you opt out as described below.
  • To communicate with you. This includes responding to inquiries, providing customer support, sending administrative messages, and providing important updates about the Services.
  • For legal and compliance purposes. This includes complying with applicable laws, responding to lawful requests, enforcing our agreements and policies, protecting rights and safety, and resolving disputes.

3. Data Use for Free, Trial, Beta, Evaluation, Preview, and Other Non-Paid Accounts

If you use the Services through a free, trial, beta, evaluation, preview, or other non-paid account, GenseeAI may collect and use Account and Contact Information, Device, Network, and Log Information, Usage and Operational Data, AI Session and Interaction Data, and Support, Feedback, and Communications to provide, secure, troubleshoot, analyze, evaluate, develop, test, train, and improve the Services.

This may include Model and Service Improvement, including improving our AI agents, workflows, platform features, evaluation systems, safety systems, and models.

You may opt out of having future eligible Service Content and AI Session and Interaction Data from your non-paid account used for Model and Service Improvement by using the controls we provide or by contacting us at info@gensee.ai.

If you opt out, the opt-out will apply to future eligible Service Content and AI Session and Interaction Data from your account after the opt-out is processed. Opting out will not require GenseeAI to remove information that was already used in completed or in-progress model training, fine-tuning, evaluation, safety, or improvement processes, or to reverse the effects of such processes. However, we will stop using future eligible opted-out content for Model and Service Improvement, subject to the operational, legal, security, fraud-prevention, abuse-prevention, compliance, backup, and technical limitations described in this Privacy Notice.

If you opt out, we may still process and retain information as needed to provide, secure, troubleshoot, support, maintain, and improve the Services in ways that do not use your future opted-out content for Model and Service Improvement, comply with law, enforce our terms, and protect against abuse.

4. Paid, Enterprise, and Customer-Contract Accounts

If you use the Services through a paid, enterprise, or customer-contract account, we do not use your Service Content, including AI Session and Interaction Data or uploaded files, for Model and Service Improvement unless you or your organization explicitly enables that use, separately agrees in writing, or otherwise directs us to do so.

By default, for paid, enterprise, and customer-contract accounts, GenseeAI does not use prompts, inputs, uploaded or referenced files, model inputs or outputs, generated content, workflow activity, execution traces, or similar AI Session and Interaction Data to train, fine-tune, evaluate, or improve generalized GenseeAI services, systems, or models.

This section does not prevent us from processing information as necessary to provide the Services, process user requests, operate workflows and AI agents, maintain security, prevent abuse, troubleshoot issues, comply with law, enforce agreements, or respond to support requests.

5. Previously Collected Data

Changes to this Privacy Notice that expand our use of Service Content or AI Session and Interaction Data for Model and Service Improvement will apply prospectively from the effective date of the updated Privacy Notice or other applicable notice.

We will not use previously collected AI Session and Interaction Data for expanded model training or generalized product improvement unless such use was permitted by the privacy notice or terms in effect when the data was collected, the user gives us permission, or the data has been aggregated or de-identified so it no longer reasonably identifies the user or their content.

If you previously allowed eligible data to be used for model training, fine-tuning, evaluation, safety, or improvement processes, later deletion, account closure, or opt-out may not remove information from completed or in-progress processes or reverse the effects of prior processing. Any opt-out will apply to future eligible data after the opt-out is processed, unless otherwise required by applicable law.

6. Automated Analysis and Manual Review

We may use automated systems to process and analyze Service Content, Usage and Operational Data, AI Session and Interaction Data, logs, traces, feedback, and diagnostic information to provide, secure, troubleshoot, evaluate, develop, train, and improve the Services, subject to the account-type limitations and choices described in this Privacy Notice.

GenseeAI does not routinely inspect or manually review uploaded file content. Authorized GenseeAI personnel and service providers may manually review selected records, including uploaded file content, only where reasonably necessary for support requested by you, debugging, security, abuse prevention, quality evaluation, model evaluation, product development, legal compliance, or enforcement of our terms. Manual review is limited to personnel and service providers with a business need to know and is subject to access controls, confidentiality obligations, and security safeguards.

For paid, enterprise, and customer-contract accounts, manual review for quality evaluation, model evaluation, or product development does not include Service Content, AI Session and Interaction Data, or uploaded file content unless you or your organization explicitly enables that use, separately agrees in writing, or otherwise directs us to do so.

7. Sensitive Information

We do not intentionally request or require users to submit sensitive personal information, secrets, credentials, private keys, payment card data, health information, government identifiers, regulated data, or other highly sensitive information through free, trial, beta, evaluation, preview, or other non-paid accounts.

However, users may choose to submit information that is sensitive, confidential, proprietary, regulated, or subject to third-party rights. You should not submit such information unless you have all necessary rights and permissions and are comfortable with the data uses described in this Privacy Notice and our Terms of Use.

We use reasonable safeguards designed to protect information processed by the Services, including access controls, confidentiality obligations, security controls, and, where appropriate, automated processes to filter, redact, or reduce exposure of sensitive information.

8. How We Disclose Information

We may disclose information in the following circumstances:

  • Service Providers. We may disclose information to vendors and service providers that help us operate, host, secure, analyze, support, maintain, and improve the Services, such as cloud hosting providers, analytics providers, error monitoring providers, payment processors, infrastructure providers, and support tools.
  • Legal Compliance and Safety. We may disclose information to comply with applicable laws, regulations, legal processes, or government requests, or to protect the rights, safety, and security of GenseeAI, our users, or others.
  • Business Transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be transferred as part of that transaction.
  • With Your Consent or Direction. We may disclose information when you direct us to do so or otherwise consent.
  • Aggregated, De-identified, or Anonymized Information. We may disclose aggregated, de-identified, or anonymized information that does not reasonably identify you or your content, including for research, analytics, benchmarking, product development, and marketing.

We do not sell personal information. We do not share personal information for cross-context behavioral advertising unless we provide any legally required notice and opt-out mechanism.

9. Your Choices

You have the following choices regarding your information:

  • Account Information. You may access and update certain account information through your account settings.
  • Cookies. You can control cookies through your browser settings and other tools.
  • Communications. You can opt out of promotional communications by following the instructions in those communications. We may still send transactional, service-related, or administrative messages.
  • Opt Out of Model and Service Improvement for Non-Paid Accounts. If you use a free, trial, beta, evaluation, preview, or other non-paid account, you may opt out of having future eligible Service Content and AI Session and Interaction Data used for Model and Service Improvement by using the controls we provide or by contacting us at info@gensee.ai. The opt-out applies to future eligible content after the opt-out is processed. It does not require GenseeAI to remove information already used in completed or in-progress model training, fine-tuning, evaluation, safety, or improvement processes, or to reverse the effects of such processes.
  • Deletion and Privacy Requests. Depending on your location, you may have rights to access, correct, delete, receive a copy of, object to, or restrict certain processing of your personal information. You may contact us at info@gensee.ai to submit a request.

10. Data Retention

We retain information for as long as reasonably necessary to provide, secure, support, maintain, and improve the Services; comply with legal obligations; resolve disputes; enforce agreements; and protect our rights and users.

Retention periods vary depending on account type, data category, user settings, sensitivity, legal requirements, contractual requirements, and operational needs. Unless a different period is required by law, security needs, deletion requests, user settings, or an applicable agreement, we generally apply the following retention periods:

  • Account and Contact Information is generally retained while your account is active and for up to 5 years after account closure where reasonably necessary for account administration, legal, security, tax, compliance, fraud-prevention, or dispute-resolution purposes.
  • Device, Network, and Log Information is generally retained for up to 5 years for security, fraud prevention, debugging, reliability, analytics, and compliance purposes.
  • Usage and Operational Data is generally retained for up to 5 years for analytics, reliability, troubleshooting, product improvement, abuse prevention, and compliance purposes.
  • AI Session and Interaction Data from free, trial, beta, evaluation, preview, and other non-paid accounts that is eligible for Model and Service Improvement may be retained for up to 5 years, unless you opt out, delete applicable data, or a different period applies.
  • AI Session and Interaction Data and uploaded file content from paid, enterprise, and customer-contract accounts are not used for Model and Service Improvement unless you or your organization explicitly enables that use, separately agrees in writing, or otherwise directs us to do so. Where such use is enabled, eligible data may be retained for up to 5 years for Model and Service Improvement unless a different period applies.
  • Support, Feedback, and Communications are generally retained for up to 5 years after resolution or last interaction, or longer where necessary for legal, security, compliance, or dispute purposes.
  • Aggregated, de-identified, or anonymized information may be retained for longer where it does not reasonably identify you or your content.

If you opt out of Model and Service Improvement, we will not use future eligible Service Content or AI Session and Interaction Data from your account for those purposes. We may continue to process and retain information as needed to provide, secure, troubleshoot, support, maintain, and improve the Services in ways that do not use your future opted-out content for Model and Service Improvement, comply with law, enforce our terms, and protect against abuse.

If eligible information has already been used in completed or in-progress model training, fine-tuning, evaluation, safety, or improvement processes, deletion, account closure, or opt-out may not remove that information from the resulting models, systems, weights, evaluations, aggregate statistics, or other outputs of those processes, and may not reverse the effects of prior processing. We will, however, apply your deletion request or opt-out to future processing of eligible information as described in this Privacy Notice, subject to legal, security, fraud-prevention, abuse-prevention, compliance, backup, and technical limitations.

11. Data Security

We take reasonable administrative, technical, and organizational measures designed to protect information from unauthorized access, use, disclosure, alteration, or destruction. These measures may include access controls, logging, confidentiality obligations, and security safeguards appropriate to the nature of the information.

However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

12. Children's Privacy

Our Services are not intended for children under the age of 13, and we do not knowingly collect personal information from children under that age. If you believe that we have collected personal information from a child under the relevant age, please contact us at info@gensee.ai, and we will take steps to delete the information as required by applicable law.

13. International Data Transfers

Your information may be transferred to, processed, and maintained on servers located outside of your country, state, province, or other governmental jurisdiction, where data protection laws may differ from those in your jurisdiction.

Where required by applicable law, we use appropriate safeguards for international transfers of personal information.

14. California Privacy Rights

We do not currently believe that GenseeAI is subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act. However, we aim to provide clear information about the categories of information we collect, the purposes for which we use information, how long we retain information, and the choices available to users.

If we become subject to the CCPA/CPRA, California residents may have rights to know, access, correct, delete, and receive information about our collection, use, disclosure, sale, and sharing of personal information; to opt out of certain sales or sharing; to limit certain uses and disclosures of sensitive personal information; and to not receive discriminatory treatment for exercising privacy rights.

15. Changes to This Privacy Notice

We may update this Privacy Notice from time to time. If we make material changes, we will provide notice as required by applicable law, which may include posting the updated Privacy Notice on our website, sending an email notification, or providing in-product notice.

Unless otherwise stated, an updated Privacy Notice applies to users who register for a GenseeAI account on or after the effective date of that updated Privacy Notice. For users who registered before the effective date, the updated Privacy Notice will not apply to their existing accounts unless and until we provide notice and the user accepts the updated Privacy Notice, opts in to the applicable data uses or settings, or otherwise agrees.

Your continued use of the Services after an updated Privacy Notice becomes applicable to your account means that you acknowledge the updated Privacy Notice, subject to any choices or rights available to you under applicable law or this Privacy Notice.
